Statement of Privacy
(last updated: May 2006)
ProTraxx, Inc.
(the “Company”, “we” or “us”)
for
www.protraxx.com
(the “Web Site”)
|
This Statement of Privacy covers the Web Site. Registered and non-registered users may use this Web Site. The Web Site
provides additional interactive services (the “Service”) to registered users. The Company provides the Service as
an application service to each of its customers (each, a “Customer”). Each registered user is affiliated with a Customer.
This Statement of Privacy describes:
- What personally identifiable information the Company collects via the Web Site and the Service.
- What organization collects the information.
- How the Company uses the information.
- With whom the Company may share user information.
- What choices are available to users regarding collection, use and distribution of the information.
- What types of security procedures are in place to protect the loss, misuse or alteration of information under the Company’s control.
- How users can correct any inaccuracies in the information.
If users have questions or concerns regarding this statement, they should first contact Director of Technology
of ProTraxx, Inc. by email at support@protraxx.com, by phone at 1.866.EzTRAXX, by facsimile at 1.860.632.8826
or by mail at 442 Smith Street, Bldg. A, Middletown, CT 06443.
Information Collection and Use
Information Collection
In order to use the Service, a user must complete a registration procedure or a user record is created through a
data import process authorized by the Customer. If using the self-registration process, the user is required to
provide contact information (such as e-mail, address, SSN and telephone number.) The Company and the Customer
with which such registered user is affiliated (the “Affiliate Customer”) use this information for the operation of the Service,
to maintain the Web Site and the Service, and to communicate with the registered user. The Service includes the initial
generation of a unique username and password upon registration and the Company and or the Affiliate Customer may
distribute such information to the user via the email address provided. Upon login, each user will have the ability to
edit the provided user name and password. Unregistered users may visit the general website without providing any contact information.
Information Use
Log Files
Like most standard web site servers we use log files. This includes internet protocol (IP) addresses,
browser type, internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number
of clicks to analyze trends, administer the Web Site, track a user’s movement in the aggregate, and
gather broad demographic information of each user for aggregate use. IP addresses, etc. are
not linked to personally identifiable information. See the “Profile” section below.
Profile
Each registered user’s Affiliated Customer may create a profile of such registered user. Such Affiliated Customer
may store information that is collected through the authorized data collection process. A profile is stored
information that details a users’ personal information. Consequently, collected information is tied to the user’s
personally identifiable information to provide unique services to that user. This privacy statement does not
cover the individual profiles stored and used by any Customer. If any registered user has questions regarding
the use and storage of such registered user’s profile and information, such registered user should contact such
registered user’s Affiliated Customer.
Intended Use of the Site
The Service is intended for users 18 years of age and older. The remaining general areas of the Web Site are
intended for educators and other adults affiliated with the management and promotion of educational opportunities.
For those users who visit the general audience areas of the Web Site, we do not collect or store any personally
identifiable information. This area of the site is suitable for all ages.
Communications from the Site
Special Offers and Updates
We may send all new registered users a welcoming email to verify password and username.
Established registered users may occasionally receive information about the Service in the
form of an email notification, update, newsletter or other correspondence related to their registration
and use of the service.
Service Announcements
On rare occasions it is necessary to send out a strictly Service-related announcement. For instance,
if the Service is temporarily suspended for maintenance we may send registered users an email.
Customer Service
We may contact certain users to provide the Service and / or to communicate issues relating to
their account via email or phone.
Sharing
Legal Disclaimer
Though we make every effort to preserve user privacy, we may need to disclose personal information
when required by law wherein we have a good-faith belief that such action is necessary to comply with
a current judicial proceeding, a court order or legal process served on the Web Site.
Third Party Intermediaries
We use a credit card processing company to bill users for the Service. The Company does not retain,
share, store or use personally identifiable information for any secondary purposes. We occasionally hire
other companies to provide limited services on our behalf, such as handling the processing and delivery of
mailings, providing customer support, processing transactions, or performing statistical analysis of the Service.
We will only provide those companies the personal information they need to deliver their services. They are
required to maintain the confidentiality of a user’s information and are prohibited from using that information for any other purpose.
Service Providers
We partner with other third parties to provide specific services. When the user signs up for these
particular services, we share names, or other contact information that is necessary for the third party to
provide these services. These third parties are not allowed to use personally identifiable information except for
the purpose of providing these services.
Business Transitions
In the event the Company goes through a business transition, such as a merger, being acquired by another
company, or selling a portion of its assets, users’ personal information will, in most instances, be part of the
assets transferred. Users will be notified via prominent notice on the Web Site for 30 days prior to a change
of ownership or control of their personal information.
Links
The Web Site contains links to other web sites. Please be aware that the Company is not responsible for
the privacy practices of such other web sites. We encourage our users to be aware when they leave the
Web Site and to read the privacy statements of each and every web site that collects personally identifiable
information so that such user can understand how those web sites collect, use and share personal information about
such user. This privacy statement applies solely to information collected by the Web Site. The Company is not
responsible for the privacy statements or other content on web sites outside of the Web Site.
Security
The Web Site takes every precaution to protect our users’ information. When users submit sensitive information
via the Web Site, their information is protected both online and off-line.
All sensitive information retained within application (such as credit card number and/or SSN) is encrypted within
the database and through any transmission of data using a 128 Bit SSL.
Correcting/Updating/Deleting/Deactivating Personal Information
If a user’s personally identifiable information changes (such as zip code, phone, email or postal address),
or if a user no longer desires the Service, we provide a way to correct, update or delete/deactivate users’
personally identifiable information through the Affiliate Customer.
Notification of Changes
If we decide to change our privacy policy, we will post those changes to this Statement of Privacy, the
homepage of the Web Site, and other places we deem appropriate so our users are always aware of
what information we collect, how we use it, and under what circumstances, if any, we disclose it.
We will use information in accordance with the privacy policy under which the information was collected.
